    Consultancy to Develop a Training Manual and Undertake Training for Judges and Magistrates on Gender Based Violence

    Background of Consultancy

    FIDA-Kenya in partnership with the Judiciary Training Institute (JTI) and with support from the United Nations Population Fund (UNFPA) seeks the services of a Consultancy firm to undertake training of Judges and Magistrates on enhancing access to justice in Gender Based Violence Cases. The consultancy shall entail development of a training manual and facilitator’s guide for training Judges and Magistrates on enhancing access to justice in Gender Based Violence Cases. The second aspect of the consultancy shall be undertaking trainings for Judges and Magistrates based on the developed training manual and other training materials.

    The training manual is expected to provide a tool for the Judiciary Training Institute (JTI) to implement initial and in-service training of Judges and Magistrates on enhancing access to justice in Gender Based Violence Cases.

    Scope of consultancy

    The consultancy firm will carry out a training needs assessment, research, collect data and prepare a training manual and facilitator’s guide on enhancing access to Justice in Gender Based Violence Cases. The firm will also work with the Judiciary Training Institute (JTI) to undertake the training of selected Judges and Magistrates using the training manual.

    4.0 Objectives of the Consultancy

    • Assess the implementation of laws on Gender Based Violence and identify gaps.
    • Establish specific training gaps and needs amongst Judges and Magistrates.
    • Develop a training manual for Judges and Magistrates on Enhancing access to justice in Gender Based Violence Cases. The training manual shall be structured and designed in modules and shall capture various aspects of access to justice in Gender Based Violence cases with a huge focus on Female Genital Mutilation (FGM) including the following:
      • An elaborate conceptual framework (Understanding Gender, Gender v. Sex, Power and Power relations amongst others).
      • Introduction to Gender Based Violence.
      • Forms and Types of Gender Based Violence
      • Causes and Contributing factors.
      • National, Regional and International Legal Frameworks on GBV (Including relevant case law).
      • State obligations on Gender Based Violence.
      • Access to Justice in Gender Based Violence Cases (Components of access to justice in GBV cases, barriers to access to justice, the justice chain and attrition, roles and duties of Judges and magistrates to ensure access to justice in Gender Based Violence cases.
    • Develop a facilitator’s guide on the training manual.
    • In collaboration with FIDA-Kenya and the Judiciary Training Institute, develop a training program and undertake training of Judges and Magistrates based the manual.

    Methodology

    The consultant will be expected to use a multi-dimensional approach to research, collect data through secondary and primary sources for the development of the training manual. The consultant is expected to conduct a thorough analysis of the relevant legal framework and identify the existing gaps and barriers to survivors of Gender Based Violence accessing Justice and the roles that Judges and Magistrates can play to enhance access to Justice for the survivors.

    The Consultant is also expected to develop an easy to use facilitator’s guide and develop an effective training program and methodology to be used for the training of the Judges and Magistrates.

    Indicative Time frame

    It is expected that the development of the training manual will be completed in 45 calendar days. The trainings shall be undertaken in the fourth quarter of 2020. **

    Reporting and Communication

    The Consultant will report directly to the FIDA-Kenya Deputy Executive Director and Head of Programs.

    Expected Outputs

    The scope of work shall be guided by the objectives as outlined above. The consultant will deliver the following outputs:

    1. An inception report on the execution of the assignment including a comprehensive work plan.
    2. Share relevant data collection and/or research tools.
    3. Training needs assessment tool and report.
    4. Present the draft and final manual and facilitator’s guide to FIDA-Kenya within the stipulated time in electronic and hard copy.
    5. Undertake trainings for the selected Judges and Magistrates.
    6. Submit detailed narrative reports of the trainings within a week of the trainings.

    Expected Profiles of the Consultancy Firm and the lead consultant

    1. Bachelor’s degree in Law, Social Sciences, Gender Studies or Research. A Master’s degree in the above will be an added advantage.
    2. A minimum of 10 years’ experience developing training manuals in the areas related to the consultancy assignment.
    3. Evidence of undertaking of similar works in the last five years.
    4. Experience undertaking trainings for the Judiciary shall be an added advantage.

    Requirements

    Interested consultancy firms should submit the following:

    • The technical proposal including an interpretation of the objectives of the consultancy, detailed methodology and an elaborate work plan.
    • The financial proposal should include a well detailed and/or itemized budget proposal; proposed terms and schedule of payment; organization/individual capacity statement, past experience and activities related to developing manuals, CVs of the consulting team and their roles in the achievement of the assignment; names, addresses and telephone numbers of three professional referees; a detailed contact address and copy of registration certificate, VAT and PIN where applicable.
