    Senior Manager - Debt Recovery

    Job Ref: Mn 7514

    JOB SUMMARY:

    The Job holder will be responsible for reviewing the Bank’s non-performing assets book and developing appropriate strategies to ensure timely recovery of amounts due, with minimum loss exposure for the Bank. Periodically reviewing securities held against NPAs in order to identify possible gaps and institute measures necessary to rectify these, so as  to safeguard the Bank’s interest.Bringing overall Debt recovery knowledge and experience to bear in advising key stakeholders on common pitfalls to avoid in the overall structuring and management of credit facilities.

    KEY RESPONSIBILITIES:

    • Providing appropriate inputs at Board and Management Committees’ level to ensure appropriate measures are taken to rectify any identified gaps in the lending process.
    • Based on overall assessment of the Bank’s NPA book and debt recovery success rate, Critically reviewing all non-performing facilities and development of appropriate strategies to ensure the Bank recovers the amounts due in an efficient and cost effective manner.
    • On a case by case basis, assessing the Bank’s positioning and its ability to recover the amounts due without forced realization of securities held as far as possible. This includes detailed negotiations with the defaulting clients for facilities re-structure, where possible, in order to maintain customer goodwill.
    • Where realization of securities held is inevitable, ensuring the process is handled procedurally in order to avoid delay through intermittent ligation. Similarly ensuring the defaulting client’s rights are respected in order to avoid potential risk exposure to the Bank through litigation or adverse publicity.
    • Undertaking periodic review of securities held against all non-performing facilities in order to ensure these are perfected and that no dilution happens during the debt recovery period.
    • Planning and closely coordinating the Debt Recovery process with various stakeholders, including Lawyers, valuers and auctioneers among others, in order to avoid undue delay and recovery costs escalation.
    • For cases in court, ensuring the relevant evidence in support of the Bank’s case is properly documented and shared with the key stakeholders in good time, ahead of court appearances. Representing the Bank as a witness as and when required.
    • Where the Bank is represented in court by other witnesses, ensuring these witnesses are well prepared with factual information and absolute clarity on the background of each case.
    • Providing periodic reports to Management and respective Board Committee’s on the Recovery Status of each non-performing facility, with clear recommendations on the way forward or closure.
    • Liaising with the Head of Credit to ensure provisions held against bad & doubtful debts are adequate and in compliance with the Prudential Guidelines.
    • Liaising with the Heads of Credit and Finance to ensure appropriate adjustments are made to the provisions for bad & doubtful debts per the Prudential Guidelines in order to comply with IFRS requirements.

    QUALIFICATIONS AND COMPETENCIES:

    • Bachelor’s degree in any business related field.
    • Professional qualifications in CPA/AKIB will be an added advantage.
    • Masters in a business related field such as Strategic Management, Economics, Finance, and Operations etc.
    • Minimum 7 years banking experience. At least 4 years should be at managerial level

    Relationship Officer - Institutional Banking

    PURPOSE:

    The role is responsible for marketing to new and existing clients to grow quality business of both the asset and liability book in line with branch targets and attain target profit for the Branch. This role is also responsible for the retention of existing Branch customers, and growing the wallet share from existing business/personal banking requirements and effective management of the relationship /customer experience. The role is also the point of contact for borrowing customers.

    PRIMARY RESPONSIBILITIES:

    • Prospecting for new business opportunities and offering the full range of Banking products and services such as personal accounts, current accounts, loans, fixed deposit accounts, card products, Internet Banking, Home Loans, Commercial Advances by way of Working Capital, Term Loans, STL’s, Hire Purchase, Asset Financing, IPF’s, Letters of Credit and Letters of Guarantees This includes engaging in activities such as:
    • Documenting Account opening and executing all KYC documents to facilitate account opening and all Bank’s products and services;
    • Obtaining related financial documents to be able to put forward any new borrowing requests from the client;
    • Preparing Call reports with recommendations and submitting for consideration by approvers;
    • Mobilizing High Cost and Low Cost Deposits and growing the Bank’s Deposit Base in line with Branch targets;
    • Providing feedback to the client on the outcome of their request and providing other solutions which could be beneficial to them in the long run; and
    • Processing and concluding transactions in a timely manner.
    • Making regular client visits to review business requirements, assessing assets under securities held or offered and submitting call reports;
    • Processing ad-hoc/additional/new requests/excesses under allotted portfolio and obtaining approvals where/when required; and
    • Cross selling the Bank’s and Group’s products.
    • Conducting reviews and renewals for existing relationships for clients enjoying various Credit facilities by proposing and recommending Credit Appraisals, making follow ups with Credit department on the offer letter and other Banks contractual documents for the client to execute for facilities approved and following up internally and externally for processing of securities and marking limits;
    • Attending to  the Credit  Audit  report and  ensuring that ARPs  are  promptly  attended to  and  resolved;
    • Making regular customer meetings and visits to build and grow the relationship;
    • Filling customer instructions/important loan related documents in the client’s respective dockets for safe custody as the information is private and confidential;
    • Reviewing Loan excess and arrears reports on a weekly basis and providing comments for all accounts listed. This involves making daily follow ups with clients to ensure that their accounts are conducted within their sanction limits and any irregular excess are regularized within the shortest time possible;
    • Approving excesses across Branches for relationship handled by the respective Relationship Managers especially in terms of excess drawing on their accounts; and
    • Reviewing and commenting on enhanced and new facilities at the end of every month as per the Central Bank of Kenya requirement to the CR HO department.
    PERSON SPECIFICATIONS

    Academic Qualifications

    • Bachelor’s degree in Business Administration/Marketing or its equivalent from a recognized institution.

     Professional Qualifications

    • Part completion of Chartered Institute of Marketing diploma or its equivalent

     Experience

    • At least one to three years relevant experience.

    Manager - Securities & Documentation Unit

    JOB PURPOSE

    Reporting to the Legal Documentation Manager, the position will be responsible for handling perfection of Legal/Credit Documentation relating to approved facilities by providing high level quality support to Securities Unit of the Legal Department, business teams and related units while providing independent control over the credit documentation and securitization process.

    KEY RESPONSIBILITIES

    • Processing of instructions to External Advocates upon receipt of duly approved Credit Approval, observing turn-around time and high standards of accuracy.
    • Ensure the appropriate security documentation on the Bank’s Standard forms have been properly prepared before dispatch to the customer.
    • Issue the disbursement go-ahead jointly with the Senior Manager, Documentation within agreed TAT on receipt of the last outstanding security document to the Credit Administration team.
    • Liaising with external legal counsel and other service providers on security documentation process and ensuring that security documentation and other conditions of sanction have been perfected/ completed prior to authorizing the draw-down of facilities (unless there is a waiver in place).
    • Liaising with Branch Managers and all business heads on all outstanding approval conditions and answering all queries relating to pending compliance certificates.
    • Issue deficiency reports upon receipt of Credit Approval and/or duly accepted Letters of offer.
    • Prepare instructions to and follow up Banks external lawyers in the preparation of security documents on behalf of the Bank
    • Processing of instructions by business for limit realignment.
    • Confirmation that security documents have been perfected and that all completion documents are in place prior to advising on lodgement of securities.
    PERSON PROFILE
    • Law degree from a reputable learning institution;
    • Advocate of the High Court of Kenya with a current practicing certificate;
    • 7 years post admission experience
    • 5 years’ experience in handling general legal matters in a reputable institution/legal firm
    • Must have excellent facilities drafting skills.
    • Must have good knowledge of all bank’s products on offer for retail customers;

    Assistant Manager - Securities and Documentation

    JOB PURPOSE

    Reporting to the Manager, Securities & Documentation the job’s purpose is to provide legal support on loan documentation, manage the documentation process, and ensure compliance on collateral conditions prior to disbursement of facilities.

    • Provide a central point of reference, support and advice on all legal documentation issues.

    PERSON PROFILE

    • Seasoned lawyer with overall 4-6 years of experience, with at least 3 years of experience in a role with a financial institution or top tier legal firm supporting financial institutions
    • Excellent level of legal documentation experience in private practice and/or as in-house corporate legal counsel
    • Demonstrable ability to draft and negotiate complex commercial agreements
    • Experience managing the work of other lawyers Law degree from a reputable learning institution
    • Advocate of the High Court of Kenya with a current practicing license
    • Expertise and experience in servicing financial industry clients in a top tier law firm or within the scope of a legal/credit department of a large financial institution

    Legal Officer - Litigation & Npa Unit

    JOB PROFILE

    • To assist in handling of litigation matters involving the Bank and/or the subsidiaries in the parent company both locally and overseas.
    • Assist in the conducting of legal research, collate evidence, prepare witnesses for pre-trial and hearing, prepare legal briefs and opinions as well as develop effective defense strategies, arguments and testimony in preparation for legal proceedings of cases in liaison with external lawyers.
    • Represent the Bank before any court or tribunal or to watch brief (where necessary).
    • Provide support on all debt collection related matters, create legal awareness and provide advice on suitable action to avert and/or minimize litigation.
    • Assist in the recovery of all NPA Accounts to the maximum extent possible.
    • Maintaining accurate management information on the entire Litigation and NPA portfolio.
    • Liaising and co-opting the assistance of all Business Units as may be necessary to recover from NPA accounts.
    • Continuously ensure the verification and evaluation of collateral held on accounts that are headed into Watch Status.
    • Assist in maintaining accurate information on individual collector’s performance and monitoring performance of the individuals/ direct reportees.
    • Action on inward communication from customers, agents and Advocates within the required bank standards and SLA.
    • Ensure Letters of Demand, Statutory Notices and other correspondences to debtors are sent as required as may be required in order to close on account as soon as practicably possible.
    • Ensuring all invoices received for services rendered to the bank in litigation and NPA matters are in compliance with the SLA’s, drawn to scale and are paid in time
    • Maintain adequate diary and/or bring up system and follow-up on diarist events.
    • Assist in the provision of necessary support to management as and when required.
    • Ensure that all shortfalls after sale are taken through the legal recovery process without undue delay.
    • Ensure Debt Recovery files are maintained and up to date and conduct proper filing.
    • Maintain highest level of confidentiality concerning the sensitive, strategic and integral legal & other information, data, decisions and developments taking place at the company.
    • Any other duties that may be assigned from time to time by the Head of Litigation, NPA Unit.
    PERSON PROFILE Key Competencies:
    • Good knowledge of the banks internal processes and loan recovery process in Kenya.
    • Strong personality with well-developed communications and inter-personal skills.
    • Negotiation skills.
    • Sufficiently computer literate to prepare and record documents and returns, with knowledge of the following being an advantage.

    Qualifications

    • Minimum (3-5) years’ experience in legal practice most especially in dispute resolution/litigation.
