    Counter Trafficking (TiP) Expert - Kenya - Better Migration Management - 9 months (renewable)

    PROJECT DESCRIPTION

    The Better Migration Management (BMM) program is based on the third objective within the EU Trust Fund, namely “improved migration management in countries of origin and transit”. It is also contributing to the second objective of the EU Trust Fund that is “strengthening resilience of communities and in particular the most vulnerable, as well as refugees and displaced people”. The BMM program takes up these challenges through a regional approach. It provides capacity building to improve migration management, in particular to prevent and address irregular migration, including smuggling of migrants and trafficking in human beings. The intervention logic is based on four components: (1) support for policy and legislative development and harmonization for better migration and border governance (2) capacity building in the form of training, technical assistance and the provision of appropriate equipment to those implementing migration related policies; (3) support to the identification, assistance and protection of migrants in need; and (4) awareness-raising with regards to alternative livelihood options, including safe migration.

    In line with the implementing strategy outlined in the Action Fiche for the implementation of the Horn of Africa Window T05 – EUTF – HoA – REG – 09, the final Description of the Action developed by GIZ as the coordinating agency, and in compliance with the overarching division of labour agreed among the consortium members, Expertise France (EF)’s contribution to the BMM project centres on the second and third specific objectives of the Action, namely:

    • To strengthen the capacity of all institutions and agencies responsible for migration and border management (capacity building), and
    • To improve the identification, assistance and protection for Victims of Trafficking (VoT) and vulnerable migrants, especially women and children, in the Horn of Africa (protection).

    EF envisages to strengthen the organizational development of inter-ministerial bodies in partner countries, strengthen their coordination roles, assist in the setting up and roll-out of robust systems and protocols, to which Government run Safe Houses should be part of. Given that EF foresees these reception facilities as a component of a boarder protection framework, EF is looking to deploy long term protection and coordination expertise (for a minimum of a 6 to 9 -month period of time) to Counter Trafficking Bodies.

    As per the Kenya National Action Plan to Combat Human Trafficking, various studies have assessed the extent of trafficking in Kenya and have confirmed that Kenya is a country of origin, transit, and destination for trafficked persons.

    For the purpose of BMM’s capacity building pillar implementation, EF is looking to second a counter trafficking and coordination expert to Kenya’s Counter Trafficking in Person Advisory Committee herein referred to as CTiP AC.

    Two key documents guide the work of the expert: The National Plan of Action for Combating Human Trafficking (Strategic Framework 2013-2017) herein referred to as the NPA; and the Counter-Trafficking in Persons Act (No. 8 of 2010) herein referred to as the CTiP Act.

    The overall objective of the expert is to strengthen the role of the CtiP AC within Kenya’s National Referral Mechanism (NRM) system, and help achieve its objective to: “advise the Minister on inter-agency activities aimed at combating trafficking and the implementation of preventive, protective and rehabilitative programs for trafficked persons.“

    The specific objectives of the expert are to provide the CtiP AC with a comprehensive approach to coordination, capacity building, data collection, information management and sharing, for the purpose of a strengthened victim centred approach within Kenya’s counter human trafficking framework. The expert will support output delivery under CTiP AC’s agreed work plan and will ensure that data collection at various level of identification, referral and assistance to Presumed Victim of Trafficking (PVoT) and Victims of Trafficking (VoT) is harmonized, and protects the rights of victims through a professional victim identification process, provision of better support and protection services, and establishment of programs for full recovery and rehabilitation as envisioned in the CTiP Act and as per NRM guidelines.

    JOB DESCRIPTION

    • DESIGNATE A COORDINATION PLATFORM
      • Support overall management of the Secretariat function within the CtiP AC;
      • Support the CTiP AC in establishing clear objectives, strategies, policies and procedures and articulation of critical actions that must be taken to tackle the CtiP AC’s participative contribution into the NRM;
    • IDENTIFY STAKEHOLDERS
      • Lead, organize and coordinate the CtiP discussion among members of the CtiP AC’s coordination platform;
      • Ensure establishment and cultivate strong working relationships with local communities, community based organisations and other local authorities as appropriate;
    • CLARIFY UNDERSTANDING OF CORE CONCEPTS, PRINCIPLES, AND CRITERIA
      • Strengthen senior managers’ understanding of human trafficking, provide clarity about operational procedure with regards to VoT’s legal status, and promote inter-departmental cooperation;
      • Initiate discussions for the development of minimum standards for comprehensive care of victims of trafficking and vulnerable migrants (age, gender, disability, origin and other specific needs);
      • In collaboration with BMM partners and with support from EF’s Protection Expert, review and disseminate and mainstream case management systems including registration, profiling, identification of key vulnerabilities, and formalization of data collection processes;
    • COLLECT AND ANALYSE DATA
      • Develop Needs overview and Response Plan towards a streamlined data management capacity;
      • Develop mechanisms to ensure the timely, coordinated, and effective response to cases of trafficking in persons;
      • Support the development of on-line and off-line platforms for data collection, management, processing and reporting;
      • Develop tools/methodology/ training as needed, to support standardized data collection and consistent evidence base;
      • Disseminate Standard Operating Procedures (SOP), information sharing protocols, and other protection safeguards designed by the Protection Expert for NRM stakeholders;
      • Oversee development of training modules along with EF’s Protection Expert and BMM partners, on a minimum of 4 topics including but not limited to psycho‐social support; security protocol and SOPs for confidential data management (development, delivery, monitoring and evaluation); referral to judiciary and law enforcement; victims needs assessment;
    • AGREE ON OBJECTIVES AND RESPONSIBILITIES
    • Support and work closely with EF Protection Expert who conducts (1) a gap analysis of non-government and government / run services in targeted areas and (2) short to mid-term material and technical needs assessments to informs EF’s delivery of receive technical and material support to identified government service providers
    • Use the Protection Expert’s findings to develop a plan for capacity development and needs assessment for material, logistical and organizational support to selected first responders (rehabilitation and upgrading to local standards, office equipment, provision of information systems);
    • Work closely with Expertise France’s Protection expert to refine the scope of services to be delivered define reception and referencing procedures in coordination with state partner services, BMM partners, civil society organizations and non-governmental partner organizations, defining operating rules and security, and standardized case management procedures;
    • Pilot mechanisms and frameworks for collecting and sharing information between selected service providers operating within a targeted area and as per NRM guidelines;
    • DEVELOP A STRATEGY FOR GOVERNMENT RUN SAFE HOUSES
    • Design a framework for the establishment of sustainable, government run safe houses
    • Initiate and conduct discussion among CtiP’s members’ findings and draw up prevention strategy informing the set up of Shelter / Safe houses.
    • Ensure that set up of Shelter / Safe Houses and services rests on prioritization and needs based approach as mentioned above and with buy in from non state actors within the NRM
    • Ensure Safe house set up is guided by evidence collected and analysed via above mentioned data management and information sharing mechanisms established within and endorsed by NRM actors;
    • Based on demonstrable benchmark achievements, advise government and stakeholders on location and requirements on safe houses for the protection of victims of trafficking (VoT), particularly women;
    • DOCUMENT, VALIDATE AND ADOPT THE STRATEGY
    • Work closely with the Protection Expert to ensure that (1) security measures are established in the safe house according to human rights standards including gender and age relevant consideration (women/ men/ children); (2) Secure and train multidisciplinary service staff in the safe house; (3) Establish management procedures and work plan in the safe houses;
    • Organise best practices and stocktaking workshop based on above mentioned methodology;
    • Support CTiP AC in Lobbying Government for allocation of budget /secure running costs in the long term;
    • IMPLEMENT THE STRATEGY
    • Initiate and coordinate among the CtiP AC membership, the identification to and activation of NRM response in areas identified as trafficking hotspots;
    • Establishment of mechanisms and frameworks for collecting and sharing information between selected service providers at localised level, connected to Master Data Base at CTiP AC level;
    • Advise Expertise France on the provision of financial support to NRM state and non state partners for direct assistance;
    • MONITOR PROGRESS TOWARDS SUSTAINABLE RESPONSE To TiP
    • Collect and analyse existing/on-going NRM assessments, data and response to establish baseline indicators for principled and sustainable response to TiP cases;
    • Work closely with Expertise France’s Protection expert to implement real-time monitoring and evaluation measures;
    • Adjust reporting indicators for the purpose of data repository in off and online database
    • Produce with the support of the CtiP membership a monthly assessment with clear recommendations;
    • Produce analysis for purpose of advocacy and response, based on evidence collected;
    • Organise best practices and stocktaking workshop based on above-mentioned methodology.

    SUPERVISING REQUIREMENTS

    • Liaise with Expertise France on a regular basis
    • Ad hoc support to BMM consortium partners
    • Supervise a National Protection Database Officer
    • Supervise IT staff to set up the database

    KEY RESPONSIBILITIES AND ACCOUNTABILITIES

    The incumbent is expected to demonstrate the following technical and behavioural competencies / accountabilities:

    A- Coordination with Government Institutions, national/local authorities, State institutions, local civil society and other relevant actors

    • Ensure that response within the NRM builds on local capacities;
    • Ensure appropriate links with national and local authorities, State institutions, local civil society and other relevant actors and ensure appropriate coordination and information exchange with them.

    B- Participatory and community-based approaches

    • Ensure utilization of participatory and community based approaches in CTiP AC strategy development, needs assessment, analysis, planning, monitoring and response.

    C- Attention to priority cross-cutting issues

    • Contribute to the development of appropriate strategies to address these issues; ensure gender sensitive response and promote gender equality across all CTiP bureaux;

    D- Needs assessment and analysis

    • Ensure effective and coherent institutional needs assessment and analysis take a gender perspective into account, involving all relevant partners;

    E- Planning and strategy development

    • Ensure predictable action within the CTiP AC membership for the following:
    • Identification of gaps;
    • Developing/updating agreed response strategies and action plans for the CTiP AC and ensuring that these are adequately reflected in overall country strategies to Counter HT (NPA, CTiP Act, 2030 Vision, etc);
    • Drawing lessons learned from past activities and revising strategies accordingly;

    F- Application of standards

    • Ensure that CTiP group participants are aware of relevant policy guidelines, technical standards and relevant commitments that the Government has undertaken under international and Domestic Law to counter Human Trafficking;
    • Ensure that responses are in line with existing policy guidance, technical standards, and relevant Government human rights legal obligations and in line with overall NRM Guidelines.

    G- Monitoring and reporting

    • Setting up data Information sharing system
    • Support set up of data management systems and a database
    • Ensure adequate monitoring mechanisms are in place to review impact and progress of the CTiP AC against implementation plans;
    • Ensure transparency, integrity, access to information and accountability principles are embraced in resource allocation and management at national and devolved levels of government.
    • Ensure monitoring efforts are linked to the National Integrated Monitoring System (NIMES)
    • Ensure adequate reporting and effective information sharing, with due regard for age and sex disaggregation.

    H- Advocacy and resource mobilization

    • Identify core advocacy concerns, including resource requirements, and contribute key messages to broader advocacy initiatives of the Government of Kenya and other actors;
    • Advocate for donors to fund NRM actors to carry out priority activities in the sector concerned (case management), while at the same time encouraging CTiP group participants to mobilize resources for their activities through their usual channels.

    I- Training and capacity building

    • Promote/support training of staff and capacity building of NRM partners;
    • Support efforts to strengthen the capacity of the national authorities and civil society.
    • Ensure that capacity building of identified member of the CtiP AC membership occurs in order to ensure on-going sustainability and quality of the response

    J- Secretariat Function

    Maintenance of the member/attendance list

    • Maintenance of an Excel sheet with member contact details;
    • Recording attendance of members;
    • Regular sharing of contact list with all members;
    • Upon request, sharing of contact list to decentralised CtiP Structures in the field;
    • Sharing of invitations and agenda at least 5 days before the meeting/event/training; as per quorum guidelines established in NPA

    Chairing of the CTiP AC - Minute taking

    • Sharing of draft minutes with all members within one week of the meeting;
    • Sharing of final minutes within two weeks of the meeting;
    • Sharing of final minutes with the CTiP AC members, the NRM Coordinators and the National and sub-national NRM Focal Points and Coordinators.

    Compiling of the updated service mapping

    • Acting as a focal point to support the protection expert in their mapping of protection services;
    • Acting as a focal point to compile into one document the updated service information;
    • Analysis of the compiled information and a summary report;
    • Sharing of updated, compiled service mapping and summary report with NRM Focal Points as well as other relevant actors;

    DELIVERABLES

    • A service providers list (4Ws) as per NRM guidelines is consolidated
    • A database of ongoing projects, including reporting on activities and services mapping, so as to identify gaps, duplications, and/or strengths is developed and maintained
    • A monitoring and evaluation framework to measure the progress of Kenya’s response with respect to prevention, protection and prosecution efforts relating to trafficking in persons is operational
    • Government owned Safe House / Shelter Guidelines are developed and endorsed
    • A reporting mechanism (including indicator matrix, and supervising of online portal design) is established
    • A viable Database system within CTiP AC for purpose of evidence gathering is established.

    REQUIRED QUALIFICATIONS AND EXPERIENCE

    Education level

    • Higher university degree in a social science or related discipline
    • Master / Phd grade

    Qualifications

    • 5 to 10 years of relevant experience in Counter trafficking / Mixed migration
    • Extensive knowledge of protection humanitarian programming
    • Experience in capacity building and coordination

    Personal qualities

    • Ability to work in a collaborative manner with team members and with multiple stakeholders at various levels from national to sub-national and community levels.
    • Excellent communication and interpersonal skills, including cultural sensitivity.
    • Demonstrated ability to work effectively in highly stressful situations.
