    Commercial Litigation Advocates (2 Positions)

    Main Duties & Responsibilities

    • Managing all phases of litigation from the taking of instructions, drafting pleadings, and discovery through pre-trial, trial, settlement, execution and appeal processes.
    • Drafting legal opinions and analysis of the law.
    • Interpretation of commercial contracts.
    • Attending court and tribunals for hearings and other related reasons.
    • Conducting negotiations between disputing parties for out of court settlements and draft settlement agreements;
    • Conducting arbitration and mediation proceedings.
    • Prepare pleadings and ensure filing in court on time;
    • Proper file management and adherence to the Civil Procedure Rules and other practice directions.
    • Keeping up-to-date with changes in the law.
    • Preparing status report for client’s files.

    Minimum Requirements

    • Advocate of the High Court of Kenya
    • Have at least three (3) years of post-admission commercial litigation experience in a busy law firm.
    • Have 2022 Practicing Certificate.
    • Certification in Mediation and Arbitration is an added advantage.
    • Have good communication, presentation and analytical skills.
    • Have the ability to work with no or very minimum supervision.
    • Ability to manage client expectations and great client interview skills;
    • High quality research skills and drafting skills;
    • High level of accuracy and attention to detail;
    • Problem solving skills and strong team player.

    Pupils - (3 Positions)

    In undertaking the pupillage programme the pupil will get access to:

    • Mentorship and on the job training;
    • Direct exposure to various areas of practice within the law firm;
    • Execution the duties of an advocate (however not fully);
    • Interaction with highly skilled and competent Advocates of the High Court of Kenya.

    Main Duties & Responsibilities

    • Drafting pleadings, commercial documents, perfection of securities documents and other documents within the firm’s practice areas for review and guidance by the pupil master.
    • In the company of Advocates, take client instructions, attend court and registries.
    • Filling and perusal of files.
    • Reading through the cases allocated to them and identifying reportable cases as per the Law Reporting Policy.
    • Preparation of case summaries for the cases identified as reportable as per the Law Reporting Policy.
    • Analyzing case law and synthesizing the trend of jurisprudence within a particular area of law.
    • Researching on precedent setting authorities within varied jurisdictions of common law
    • Liaising with judicial offers and judicial researchers in order to keep abreast with the development of jurisprudence within a given area of law
    • Writing analytical summaries of written arguments or evidence and assessing the argument in light of academic legal literature and case law
    • Carrying out research on changes which have taken place in the Laws of Kenya so as to facilitate revision of statutes
    • Conducting situational analysis of the legal systems.
    • Filling of LSK workbook weekly.
    • A current practicing certificate, or have completed a practical legal training course
    • Discuss learning and mentorship progress regularly.

    Minimum Requirements

    To qualify for a pupillage position with CR Advocates LLP, applicants must:

    • Have been admitted to the Advocates Training Programme at the Kenya School of Law in its current academic year and completed exams.
    • Hold an LLB degree from a reputable and qualified institution with no less than an upper second class honours;
    • Have interned in a law firm for at least 3-6 months from the time of joining campus.
    • Hold a KCSE Certificate (or equivalent) with a mean B average and a B grade in English;
    • Excellent professional conduct, etiquette and good work ethics.
    • Excellent communications skills in both verbal and written.
    • Computer literate.
