    Legal Officer - Litigation (Faulu MFB)

    Job Description

    Reporting to the Head of Legal Services, the job holder is responsible for the effective and efficient management of legal matters related to credit with direct support to Credit Administration and Debt Recovery departments respectively and provision of legal advisory services to the organization and ensuring effective management of legal and credit related risks.

    KEY RESPONSIBILITIES

    Leadership role

    • Provide leadership and ensure efficient and effective management of staff and resources reporting to job holder including mentorship, coaching and training.
    • Liaise with the Head of Legal Services in conducting performance appraisals and ensure competency and training gaps are addressed.
    • Represent the Head of Legal Services in various internal or external meetings or committees when called upon.
    • Provide monthly and quarterly reports to the Head of Legal Services on job holder duties.

    Litigation management

    • Maintain and update the database of cases and management of litigation.
    • Review progress of outstanding litigation and liaise with on appropriate strategies for cases.
    • Collate documents and any evidence, identify and prepare witnesses in support of Bank cases.
    • Diarize hearing notices for pending cases, follow up and update of outcome thereof to Head of Legal Services, Debt Recovery Unit (DRU) and Branch (where applicable)
    • Provide support to the Debt Recovery Unit in various recovery processes including but not limited to:-
    • Ensure compliance by DRU team on the necessary statutory requirements and processes.
    • Review and issuance of statutory notices
    • Legal advisory of various recovery matters
    • Manage external counsel handling various litigation matters including issuance of instructions, timely drafting of pleadings, review of pleadings, review of advocates performance.
    • Issuance of Legal opinions and recommendation on various litigation matters.
    • Negotiation of out of court settlement with customers
    • Management of legal costs associated to litigation.
    • Attending Court and representing the company in legal issues when required.
    • Review and manage demand letters from customers or third parties.

    Credit Documentation and perfection of securities

    • Draft, review and ensure proper facility letters, Bank’s standard forms and templates, securities documentation and service level agreements and standard agreements, properly drafted and legally enforceable to ensure and in compliance to regulatory changes and general securitization requirements. to safeguard the bank’s exposure.
    • To capture, register, monitor, control and report all types of collateral offered by the customers and ensure that they are properly lodged for registration.
    • Liaise with external legal counsel to ensure proper preparation, execution, registration and perfection of securities within the agreed SLA.
    • Review and ensure all security documentation and other necessary documentation.

    Legal Risk Management and Advisory

    • Provision of sound legal advice to the business/ staff on existing or emerging laws, operational requirements.
    • Continually reviews, develops and refines legal policies and procedures to determine their suitability for the bank’s requirements and recommends modification and upgrading to meet the desired standards and changes in the bank’s risk profile.
    • Participate in drafting and review of various risk policies and procedures to comply with the bank’s strategy and objectives.
    • Ensure any policy or identified regulatory breaches are properly authorized at the correct level.
    • Periodically do risk review of new and existing credit products and non-credit products with inherent risks and advise the management on remedial measures.
    • Manage the performance and relationships of third- party legal service providers.
    • Monitor and manage Legal and Legal Product Risks within the business.
    • Liaise with relevant departments to ensure that where legal risks have been identified, appropriate courses of action have been taken.
    • Provide and interpret legal information, conduct training and disseminate appropriate legal requirements to management and staff.

    Bank-wide AML KYC & CFT Responsibilities

    • Communicating and reinforcing the AML-CTF compliance culture established by the board.
    • Implementing and enforcing the board-approved AML, KYC & CFT policy within the Department.

    Education

    • Litigation and Debt Recovery Processes
    • Ability to deal with and effectively manage senior stakeholders confidently Proficiency in Computer Skills;
    • Strong Oral and Written Communication skills.
    • Honest, Transparent and demonstrate high level on integrity.

    Experience

    • At least three (3) years extensive legal experience either from a banking institution with extensive exposure to litigation, debt recovery and security perfection
    • Working knowledge of both the legal requirements and lending practice for financial institutions
    • particularly lending to the different market segments
    • Exposure to CBK compliance requirements will be a definite advantage.
    • Ability to work with minimum supervision

    Claims Analyst

    Job Description

    To process general insurance claims in an expeditious and professional manner thereby meeting the customer’s expectations and the overall departmental objectives.

    KEY TASKS AND RESPONSIBILITIES

    • Reviewing and processing general insurance claims and giving recommendation on settlement or repudiation.
    • Liaising with customers and intermediaries for full claim documentation.
    • Acknowledge and response to incoming communication and general correspondences e.g., email, letters, phone enquiries etc.
    • Ensuring service providers are appointed promptly to avoid delays in processing of claims. Also following up for submission of their reports as per set TATs.
    • Fraud Management - red flag any suspected cases of fraud and report the same to the supervisor for further review/analysis.
    • Setting claims reserves and having them regularly reviewed to reflect current position of the company’s liability.
    • Participating in periodical reserve review exercises on outstanding files.
    • Updating clients and intermediaries on claim statuses.
    • Processing of customer payments within the set TATs.
    • Liaising with the supervisor for timely resolution of claims complaints.
    • Maintaining effective business relationships by constantly interacting with the various intermediaries and customers together with the service providers to ensure customers have an excellent and pleasant experience.
    • Institute claims recovery and issue demand letters where there are recovery prospects. 
    • Liaising with underwriting department by notifying them on risk improvement issues and gaps noted during claims processing.

    Manager Transaction Banking and Digital Sales (Faulu MFB)

    Job Description

    • Champion sales and utilization of Transaction Banking and eBanking solutions as the preferred delivery channels in the bank. Initiate strategies and products which will ensure growth of Non-Funded Income (NFI) and cheap liabilities.
    • Co-ordinate Sales initiatives with the Relationship Managers/Officers/team leader sales of the bank and provide support in growing liabilities and transactional business.
    • Co-ordinate with customer experience team to offer exceptional customer service to customers. Liaise with operations to ensure smooth running of Transaction Banking products.
    • Continuously advise the bank on the new industry developments on the Transaction Banking and eBanking

    Duties and Responsibilities

    Business Development & Liquidity Management-50%

    • Work closely with MSME, SME and Community RMs, IB RMs, Business Banking and Retail Banking relationship team on fully embedding Transaction Banking solutions into the customer business.
    • Co-ordinate Sales, Product Management, Customer Service and Operations to ensure client satisfaction.
    • Responsible and accountable for product revenue realization.
    • Become the Customers trusted advisor for the delivery of the e-Banking and Transaction banking solutions.
    • Advise the bank management on any new developments in the eBanking and Transaction Banking front to keep pace with competition.
    • Drive and deliver exceptional sales performance by identifying and meeting customer needs through selling & cross selling of Specific Transaction Banking Products & Services.
    • Identify cross–sell opportunities when making customer contact so as to maximize the customer value from each interaction.
    • Champion product and sales activities to drive business growth.

    Business Planning and Strategy -25%

    • Support in the development and execution of strategic client plans and drive the implementation of client plans.
    • Develop and prepare standard proposals and presentations for banking services that will be pitched to potential clients.
    • Liaise with the bank developers and partners to continuously promote and design competitive products for the bank.
    • Become the point of reference for clients and bank on the Transaction Banking initiatives.
    • Implement e-banking and Transaction Banking product solutions to clients, of varying size and complexity.
    • Assess and recommend pricing guidelines for Online Banking and Transaction Banking products to ensure that we remain competitive and at the same time increase overall revenue collection.
    • Provide MIS and metrics on progress of deals managed and provide input to management on customers implementation progress and issues, for discussion with Relationships Managers.

    Service Management-15%

    • Implement eBanking and Transaction banking product solutions to clients, of varying size and complexity.
    • Either through own initiative, or teams, be a pro-active member of the department, working to reduce implementation cycle time.
    • Co-ordinate resolution of Transaction Banking related problems within the agreed TAT.
    • Become the point of reference for clients and bank on the Transaction Banking initiatives.
    • Provide MIS and metrics on progress of deals managed and provide input to management on customer implementation progress, and issues, for discussion with Sales Managers, and Relationship Managers.
    • Offer product training to staff across the bank.

    Cost Containment10%

    • Ensure Return on Equity is achieved for all facilities advanced to clients by driving to achieve agreed share of wallet (SOW) for Transaction Banking products.
    • Ensure our Cost of Funds are effectively managed by pursuing and retaining cheap liabilities through utilization of Transaction Banking products.
    • Ensure prudent use of bank resources such as taxis and during customer events such as lunches.

    Education

    • University Degree in a Business/IT Related Field - Minimum Upper 2nd Class Honors Professional:
    • ACIB/AKIB Banking qualifications will be an added advantage.
    • A professional qualification in IT or project management field is an added advantage. Desired work experience:
    • 3-year customer service/sales roles in the financial sector will be an added advantage.
    • Proficient in Ms Office Suite – Ms Word, Power Point, Ms Visio, Ms Excel, Ms Access etc.
