    Senior Manager - Legal & Advisory

    REPORTING TO: DIRECTOR LEGAL AND ADVISORY
    DIRECTORATE: LEGAL & ADVISORY
    UNIT/DEPARTMENT: LEGAL
    GRADE: CAJ 4

    JOB PURPOSE


    This position is responsible for ensuring the effective and efficient handling and resolution of complaints made against public agencies or officers and to provide technical, administrative, strategic and legal services to the commission.

    Managerial Responsibilities

    a) Support in the formulation and implementation of policies and strategies for effective discharge of the functions of the directorate in accordance with the strategic goal of the commission
    b) Develop the directorate work plan, procurement plan and quarterly progress reports to ensure that activities are on track and in accordance with the mandate of the commission
    c) Organize and allocate tasks to staff members in the directorate to ensure optimal utilization of the resources in the department
    d) Monitor the implementation of projects within the directorate to ensure that project goals and timelines are met

    Operational Responsibilities:

    a) Handle complaints by clients against public agencies or officers on matters that relate to administrative justice
    b) Represent the commission on legal proceedings before courts and tribunals on matters that relate to administrative conduct of public agencies or officers
    c) Prepare on behalf of the commission sound legal and advisory opinions on complaints that have been wedged against public agencies and officers
    d) Conduct legal research on cases pending before the commission to come up with an opinion to determine the way forward in the pursuit of justice for the complainants
    e) Draft and review contracts for the commission to ensure that the commission’s risk is limited
    f) Implement mechanisms for formal hearings by the commission to facilitate investigations into matters arising from the administrative conduct of public agencies or officers
    g) Draft court documents on complaints that relate to administrative justice to ensure that the complaints are handled efficiently and that justice is achieved
    h) Draft reports on legal matters: special reports, annual and bi-annual reports for review by the Director to determine the performance of the directorate
    i) Participate in the promotion of public awareness of policies and administrative procedures on matters that relate to administrative justice and outreach activities by the commission

    Academic & Professional qualifications

    • Master’s Degree in any related field
    • Bachelor’s Degree in LLB
    • Post graduate diploma in law
    • Other required knowledge that would be regularly applied to the job

    a) Knowledge and exposure to Alternative Dispute Resolution mechanisms
    b) Computer literacy
    c) Thorough understanding of the constitution, legal policy and institutional framework in the public sector
    d) Knowledge of professional ethics and standards

    Manager - Supply Chain Management

    REPORTING TO: COMMISSION SECRETARY
    DIRECTORATE: FINANCE AND ADMINISTRATION
    UNIT/DEPARTMENT: SUPPLY CHAIN
    GRADE: CAJ 5

    JOB PURPOSE


    This position is responsible for ensuring the effective and efficient handling and resolution of complaints made against public agencies or officers and to provide technical, administrative, strategic and legal services to the commission

    Managerial Responsibility

    a) Formulate the annual procurement plans for the commission on Administrative Justice in line with the
    Public Procurement Oversight Authority
    b) Oversee the preparation of bid documents, quotations, requests for proposals and reports for use by the tender committee
    c) Develop systems and procedures for the procurement of goods and services useful for the commission
    d) Guide in the implementation of public procurement legislation and supply chain management contracts to the procurement committee
    e) Ensure compliance with best practices in procurement and supply chain management.
    f) Coordinate the preparation of tender documents according to the national procurement guidelines
    g) Ensure all departments and staff in the Commission on Administrative Justice are familiar with and comply with the procurement guidelines
    h) Supervise and appraise staff in the unit to fully utilize internal capacity and maximize output

    Operational Responsibility

    a) Coordinate the implementation of the overall commission procurement plan and e- procurement strategies to remain compliant with regulations
    b) Review vendor contract document such as Local Purchases Order and Local Sales Orders for approval by the Director of finance in the commission in response to requisitions from user departments
    c) Lead in the opening of bid documents and communicate to the tender participants on the outcome of the bid to ensure transparency
    d) Coordinate the disposal of unserviceable assets by following the guidelines of the Public Procurement and Disposal Act
    e) Manage supplier relationships and database for the commissions vendor services as a procurement directory
    f) Conduct market intelligence/ market surveys on suppliers and standards on quality control of procured good and services
    g) Capacity building for commission staff in the form of in-house trainings on procurement regulations
    h) Ensure maintenance of records and the performance of suppliers for purposes of providing performance feedback and updating service providers
    i) Manage the procurement life cycle from supplier selection, contract and price negotiation maintain client - stakeholder relationships
    j) Monitor performance targets for the department and mentor staff to enhance internal capacity for optimum delivery

    Academic qualifications

    • Master’s degree in Procurement & Supplies or any related field.
    • Bachelor’s degree in Commerce, Procurement or Supplies management or other relevant fields from a recognized Institution.

    Professional qualification

    • Post graduate diploma in procurement or supply chain management from a recognized institution
    • Must be a registered member of KISM

    Added Advantage

    • Knowledge of government procurement procedures
    • Proficiency in use of procurement systems most desirable IFMIS
    • Registered with Kenya Institute of Supplies Management

    Relevant experience required

    • Ten (10) years of service, in a comparable position from a reputable organization

    Senior Legal Officer

    REPORTING TO: DIRECTOR, LEGAL AND ADVISORY
    DIRECTORATE: LEGAL & ADVISORY
    UNIT/DEPARTMENT: LEGAL
    JOB GRADE: CAJ 6

    JOB PURPOSE


    This position is responsible for receipt, address and resolution of complaints received and to render legal services as per the mandate and functions of the Commission.

    KEY RESPONSIBILITIES

    Duties and responsibilities will entail:


    • Attending to clients on matters relating to administrative justice and offering legal advice thereon;
    • Representing the Commission in legal proceedings, including amicus briefs;
    • Assisting the Commission in conducting hearings, inquiries and investigations in matters falling within its mandate;
    • Conducting legal research on disputes relating to administrative justice and proposing appropriate determinations, decisions or recommendations thereon;
    • Assisting the Commission in resolution of complaints through ADR including mediation, negotiation and reconciliation;
    • Preparing periodic reports on complaints investigated and remedial action taken by the Commission;
    • Participating in public education and outreach programmes of the Commission;
    • Participating in the preparation of work plans, procurement plans, progress reports, and other statutory reports of the Commission.
    • Preparing Legal and advisory opinions;
    • Providing recommendations or remedial alternatives for resolution of disputes
    • Reviewing files and other assignments allocated to Legal Officers and Legal Interns
    • Exercising supervisory and disciplinary control over officer’s subordinate to the position

    JOB REQUIREMENTS

    • A Bachelor of Laws Degree (LL. B) from a recognized University
    • An Advocate of the High Court of Kenya
    • A member of the Law Society of Kenya in good standing
    • At least five (5) years post admission experience in litigation in a busy environment preferably in a public institution
    • Experience in handling and resolution of complaints will be an added advantage
    • A post graduate qualification in law or other relevant filed will be an added advantage
    • A valid practising certificate
    • Meet the requirements of Chapter 6 of the Constitution of Kenya
    • Willingness to serve the people of Kenya in any station within the Republic

    DEPLOYMENT

    • The successful candidate should be open to work in any station where the Commission has business in Kenya.
