    Consultant Development of Resettlement

    Specific Objectives

    The specific objectives of this consultancy are:

    • To develop a draft legislation on resettlement action plans and asset valuation in Kenya law with progressive language supportive of Kenya’s existing constitutional obligations;
    • To develop a standardized tool kit identifying the standard bare minimums that must be included in Resettlement Action Plans and Asset Valuation Bill
    • To submit a final report on the content of proposed model law.

    Scope of work and main tasks

    The Consultant shall be required to:

    • Participate in an inception meeting and prepare an inception report detailing the methodology to be employed and the work plan;
    • Finalize a jointly agreed work plan and map out timelines for activities;
    • Conduct a one-day training for LSK team and like-minded partners on minimum content of the Resettlement Action Plans and Asset Valuation in Kenya Law;
    • Map out stakeholders from the civil society, government, constitutional institutions and rights holders’ engagement in the model law development process;
    • Hold a one-day stakeholder forum to discuss content of proposed model law;
    • Develop a report detailing the discussions from the one day stakeholders’ forum.
    • Undertake a one-day validation meeting with stakeholders to review draft model law.

    Deliverables

    The Consultant will complete and submit the Resettlement Action Plans and Asset Valuation model law in soft copy and a draft report of the one day stakeholders’ forum that captures the analysis of the inputs. The Consultant will finalize the resettlement action plans and asset valuation model law and the report incorporating the comments/suggestions of stakeholders. The key deliverables for the assessment are as follows:

    • Inception report, detailing the general understanding of the assignment, approach,work plan, budget and deliverables;
    • Final work plan with timelines as agreed on with LSK;
    • Organize one-day meeting with LSK team and likeminded CSOs to identify what ought to be included in the bill;
    • Draft report on findings from the one day stakeholders’ forum;
    • Developing a draft of the Resettlement Action Plans and Asset Valuation in Model law with progressive language guided by and reflective of Kenya’s obligations at national and regional level;
    • A standardized toolkit identifying the bare minimums/key asks that must be constituted for the RAP bill;
    • Conduct validation meeting to discuss the draft resettlement action plan and asset valuation model law.

    Time Frame

    The assignment should be completed within one (1) month of signing the Agreement. The consultant will be engaged for a period of 18 working days and this shall be spread over the one-month period in accordance with the work plan. 10 days shall be dedicated to the development of a draft of the Resettlement Action Plan and Asset Valuation Model law; the training of the LSK team on minimum content of Resettlement Action Plan Model Law, mapping out stakeholders from the civil society, government, constitutional institutions and rights holders’ engagement in the model law development process; holding a one-day stakeholder forum to discuss content of proposed model law; develop a report detailing the discussions from the one day stakeholders’ forum and undertake a one-day validation meeting with stakeholders to review draft model law and agree to it. The final eight days shall be dedicated to the review of the model law, report and recital and the finalization of the documents.

    Qualifications of the Consultant

    Functional Competencies:

    • Knowledge on legal frameworks, legal drafting and land law;
    • Ability to research and write at a high level.

    Core Competencies:

    • Ability to produce high quality outputs in a timely manner while understanding and anticipating the evolving client needs;
    • Strong organizational skills; and
    • Ability to work independently, produce high quality outputs.

    Required Skills and Experience

    Education

    • Master’s degree in Law or related field

    Experience:

    • Minimum of 5 years of relevant experience is required.
    • Language: Excellent written and spoken English.

    The individuals whose CVs are submitted in the proposal will undertake the assignment and work directly with LSK team; any replacement or substitution of the consultants will be treated as breach of agreement.
