    Legal Fellows

    About the Externship Programme

In Africa, efforts have and continue to be made towards ensuring that the rights and protections enshrined in regional and international human rights treaties are accessible to all women and girls. For instance, many African countries are states parties to the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), and the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa (“the Maputo Protocol”).  The Externship Programme seeks to place two talented Legal Fellows with Judges of the High Court of Kenya for a period of one year from November 2021.

Overall Role and Responsibility of the Legal Fellows

The primary role and responsibility of the Legal Fellows shall be conducting specialised legal research and analysis, as well as drafting legal memos and opinions on women’s and girls’ rights, as assigned by the Judges to whom the Legal Fellows are attached. The research and analysis will assist Judges in utilising the Maputo Protocol and other international human rights instruments in their rulings and judgements. Legal Fellows shall also be required to carry out their own self-directed research and writing on salient women’s and girls’ rights topics in general and family law topics. Additionally, the Legal Fellows may receive assignments from the Legal Equality (Africa) team relating to their primary role and responsibility outlined in the foregoing from time to time.

Specific Roles and Responsibilities of the Legal Fellows

    1. Attend an induction training on the Externship Program and official introductory meeting with their assigned Judges and other Judiciary officials related to their roles and implementation of the program.
    2. Assist Judges in identifying new areas of research and intervention on legal issues affecting women and girls in Kenya.
    3. Assist Judges in drafting of legal memos, legal opinions, case summaries, judgements and rulings as directed.
    4. Work closely with Judges to identify opportunities for Equality Now to provide technical support and engage with the Judiciary of Kenya to create awareness on and enhance implementation of regional and international human rights instruments on the rights of women and girls within domestic courts.
    5. Assist judges, the Judiciary of Kenya and Equality Now in identifying and tracking developments on contemporary issues and the rights of women and girls at the national, regional, and international levels.
    6. Prepare monthly reports on work undertaken and objectives achieved, to be shared with the assigned Judges and Equality Now for assessment and learning purposes.
    7. Carry out their own self-directed research and writing on salient women’s and girls’ rights topics and themes.
    8. Carry out research and writing related to Legal Equality in Africa as assigned by Equality Now.
    9. Perform any other related duties as assigned by Judges and/or Equality Now.
    10. Prepare monthly, quarterly, mid-year and end of program reports detailing work undertaken, especially highlighting notable assignments and achievements; objectives achieved; challenges faced; opportunities missed and those identified; lessons learnt; and recommendations for enhancing the Externship Program.
