    Legal Researchers

    OBJECTIVE OF THE ASSIGNMENT

    The main objective of the service is to carry out legal research on each and every case broughtbefore the Review Board, and provide assistance in judicial review cases and appeals in cases where the Review Board is a Party, as well as research on matters of judicial interest and relevance to the Review Board.

    SCOPE OF WORK

    The successful legal researcher will be expected to undertake research on points of law as instructed relating to the mandate of the Review Board by the Constitution, the Public Procurement & Asset Disposal Act, 2015, the Public Procurement & Asset Disposal Regulations, 2020 and other relevant laws.

    This will include but not limited to:

    • Research, identify appropriate laws, judicial decisions, legal articles and other material that are relevant to assigned cases;
    • Compile statistical analyses of cases handled by the Review Board;
    • Prepare written legal opinions on ongoing cases that the Members of the Review Board can make reference to in development of their decisions;
    • Assist the Board Secretary to liaise with the Attorney–General’s Office
    • on Judicial Review; and appeal matters by Preparing Pleadings,
    • Replying Affidavits and Instructions;
    • Preparation and submission of monthly progress reports;
    • Attendance of relevant meetings as may be required;

    DURATION OF THE CONTRACT

    • The duration of the contract will be six (6) months with the possibility of a further extension of six (6) months subject to performance and the need for continued services.

    DUTIES AND RESPONSIBILITIES OF THE LEGAL RESEARCHER
    The specific duties and responsibilities will include:

    • Research on points of Law as instructed relating to the mandate of PPARB by the Constitution, the Act and the Regulations;
    • Investigate facts of cases and ensure all relevant information pertinent to assigned cases is provided for consideration by the Review Board;
    • Research and identify appropriate laws, judicial decisions, legal articles and other material that are relevant to assigned cases;
    • Monitor and report compliance with summons, orders and decisions made by PPARB, and other Courts on matters involving PPARB;
    • Compile statistical analyses of cases handled and activities undertaken by PPARB;
    • Ensure the Board Members are fully prepared for closings, hearings, trials and Board meetings;
    • Where so instructed, provide support in mediating or arbitrating disputes and in appeals’ hearings;
    • Prepare written legal opinions on ongoing cases that the members of PPARB can refer to in development of their decisions;
    • Oversee the organization of files of cases to make them accessible to the presiding Chair and/or members of PPARB;
    • Coordinate and facilitate the retrieval of trial records;
    • Organize, draft, coordinate and compile documents relating to the various programs/meetings/workshops/conferences of PPARB’s mandate, project and expert group reports, taking detailed notes at meetings and conferences;
    • Write relevant and periodic reports from information acquired in various workshops;
    • Where so requested, develop media briefs for the Board Secretary/CEO and Board members on the legal aspects of the work of PPARB;
    • Assist the Board Secretary to liaise with the Attorney–General’s Office on judicial review and appeal matters by preparing pleadings, replying affidavits and Instructions;
    • Monitor progress and status of judicial review and appeal cases at the Court and compile statistical and legal analyses of judgements rendered thereof and advise PPARB on the same;
    • Any other relevant duty or responsibility assigned by the Board Secretary/CEO.

    REQUIREMENTS FOR APPOINTMENT

    • The successful candidate should possess the following qualifications:
    • Bachelor’s Degree in Law (LL.B) from a recognized university;
    • Post Graduate Diploma in Law;
    • Advocate of the High Court of Kenya;
    • At least two years’ relevant experience;
    • Relevant professional registration;
    • Computer proficient;
    • High level of integrity and ability to maintain confidentiality; and
    • Experience in legal research and knowledge of the Public Procurement and Asset Disposal Act 2015, and Public Procurement & Asset Disposal Regulations 2020.
