    Director Complaints, Investigations and Legal Services

    REPORTING TO: COMMISSION SECRETARY/CEO
    DEPARTMENT: COMPLAINTS, INVESTIGATIONS AND LEGAL SERVICES
    JOB GRADE: CAJ 2
    NO. OF POSTS: 1
    TERMS OF EMPLOYMENT: 4 YEAR CONTRACT

    JOB DESCRIPTION

    The Director, Complaints, Investigations and Legal Services will be responsible to the Commission Secretary for strategic leadership and management of the Complaints, Investigations and Legal Department.

    Specific duties and responsibilities will entail: -

    • Develop, review and implement policies, strategies and guidelines on complaints, investigations and legal matters;
    • Coordinate the handling of complaints, investigation and legal services;
    • (iii) Coordinate the design and facilitate mechanisms for formal hearing and inquires by the Commission;
    • Develop and review guidelines on implementation of Alternative Dispute Resolution mechanism;
    • Coordinate investigation on any conduct in state affairs, or any act or omission in public administration by any State organ, State or public officer in National and County Governments that is alleged or suspected to be prejudicial or improper or is likely to result in any impropriety or prejudice;
    • Coordinate investigation on complaints of abuse of power, unfair treatment, manifest injustice or unlawful, oppressive, unfair or unresponsive official conduct within the public sector;
    • Advise on modes and mechanisms for mediation and reconciliation;
    • Provide advice on all legal aspects of the Commission, Regulations and other legal statutes;
    • Coordinate Commission’s litigation matters with external Advocates;
    • Coordinate preparation of investigation reports carried out on maladministration;
    • Coordinate enforcement of matters of non-compliance with legal and regulatory framework on licenses and other parties with the relevant department;
    • Coordinate drafting of legal instruments based on policy proposals by the stakeholders;
    • Manage complaints database and;
    • Any other duties as may be assigned from time to time.

    JOB SPECIFICATIONS

    For appointment to this grade, a candidate Must: -

    • Have relevant experience in a managerial position for a minimum period of ten (10) years;
    • Have a Bachelor degree in any of the following disciplines: - Law, Sociology, Governance, Public Administration, Criminology, Forensic Science or any other equivalent qualification from a recognised institution;
    • Have a Master’s degree in any of the following disciplines: - Law, Sociology, Business Administration/Management, Public Administration, Governance, Organisational leadership and any other equivalent qualification from a recognised institution;
    • Have a certificate in Strategic Leadership course and/or Corporate Management Course lasting not less than four (4) weeks from a recognized institution;
    • Be a registered Member to a professional body in good standing where applicable;
    • Have a certificate in Computer Application Skills from a recognized institution;
    • Meet the requirements of Chapter 6 of the Constitution on Leadership and Integrity; and;
    • Demonstrate professional competence and administrative capability as reflected in work performance and results.

    CLEARANCE/COMPLIANCE CERTIFICATES

    Successful candidates will be required to provide copies of clearance or compliance certificates from:

    1. Kenya Revenue Authority
    2. Ethics & Anti-Corruption Commission
    3. Directorate of Criminal Investigations (CID)
    4. A credit reference bureau
    5. Higher Education Loans Board
